Louboutin v. Madonna

Our friends over at The Cut posted images of Madonna's first Truth or Dare footwear collection yesterday. While this is the first look at the collection, chances are, you've seen it before ... at a Christian Louboutin store. Manufactured by Aldo Group, Inc. and set to hit stores this fall, Madonna's collection is anything by original. Of the pictures of 32 styles that have been released, there are several very striking similarities. Cheap Louboutin knock-offs, anyone?

Despite unmistakeable similarity, Aldo, the company that "designed" the shoes is not doing anything illegal in the U.S. as the only protection Louboutin has is over his trademarked red soles. If the Madonna shoes had red soles, Louboutin would be able to bring a lawsuit for trademark infringement and trademark dilution. However, even though the Aldo designs are strikingly similar to Louboutin's, because there is extremely limited protection for actual designs, Madonna and Aldo are in the clear. If Madonna tries to sell the shoes in France or the UK, Louboutin could likely bring a suit as these nations provide protection for original fashion designs, in addition to trademarks.
